1. THE PROMOTER
1.1 The promoter is Trainline.com Limited, (company number 3846791) whose registered office is at 120 Holborn, London, EC1N 2TD (“Promoter”).
2. THE COMPETITION
2.1 The title of the competition is the “Trainline Student Travel Fund” (“Competition”).
2.2 In order to be in with a chance of winning the Prize, you will need to submit answers to five (5) different questions relating to travel in Europe.
3. HOW TO PARTICIPATE
3.1 In order to enter this Competition, go to https://www.thetrainline.com/trains/study-abroad and enter the information requested.
3.2 All entries must include your full name, date of birth email address, full details of the current University or College that you attend and full details of the University or College where you are or will be undertaking your study abroad program.
3.3 Each question shall have a limit in terms of the number of characters that can be used to answer. The number of permissible characters will be set against each question on the entry form.
3.4 Entries that do not comply with these promotion rules will be void and will not be entered into this Competition
3.5 You may only submit one entry to this Competition. Entries over the maximum number of entries will be void and will not be entered into this Competition.
4. START DATE
4.1 This Competition will start at 00:00 on Monday 2nd December 2019.
5. CLOSING DATE
5.1 The closing date for this Competition will be Friday 31st January at 23:59. Entries received by the Promoter after this time will be void and will not be entered into this Competition.
6. SELECTION OF THE WINNER AND JUDGING CRITERIA
6.1 This Competition is a game of skill and chance plays no part in determining the First Place Winner, Second Place Winner and Third Place Winner.
6.2 The winners of the Competition will be the submission chosen by a panel of three (3) judges within the Promotor’s United Kingdom marketing team to be: (i) the most original; and (ii) express the most passion about travel in Europe, out of all entries correctly submitted in accordance with these terms and conditions (“First Place Winner”).
6.3 In addition, the judges will on (1) Second Planner Winner and one (1) Third Place Winner based on the same judging criteria as described in section 6.2 of these terms and conditions (“Second Place Winner and Third Place Winner”).
6.4 The name of the judges are available on request.
7. PRIZE
7.1 The First Place Winner shall receive the following:
7.1.1 an Eurail or Interrail Pass eligible for seven (7) days travel in a month;
7.1.2 one thousand five hundred euros (€1500) in spending money; and
7.1.3 subject to availability, the opportunity to write one (1) article for Via,
together the (“First Place Winner’s Prizes”).
7.2 The Second Place Winner shall receive the following:
7.2.1 an Eurail or Interrail Pass eligible for seven (7) days travel in a month; and
7.2.2 subject to availability, the opportunity to write one (1) article for Via,
together the (“Second Place Winner’s Prizes”).
7.3 The Third Place Winner shall receive the following:
7.3.1 an Eurail or Interrail Pass eligible for three (3) days travel in a month; and
7.3.2 subject to availability, the opportunity to write one (1) article for Via,
together the (“Third Place Winner’s Prizes”).
7.4 The First Second and Third Place Prizes shall together be the Prizes for the purposes of these terms and conditions.
7.5 There are no alternative Prizes. The Prizes are non-transferable and do not include any additional costs and expenses.
8. RESTRICTIONS AND REQUIREMENTS
8.1 Entrants must meet the following criteria to enter the Competition:
8.1.1 Entrants must:
(a) be a student based in the United Kingdom or the United States of America; and
(b) be enrolled in a United Kingdom or United States of America University or College that organises study abroad programs in European countries in which the Promoter does business; and
(c) be enrolled in a United Kingdom or United States of America University or College for the academic year 2019/2020 and able to provide a "proof of enrolment” document evidencing such enrolment to the Promoter (“Proof of Entitlement”); and
(d) be able to submit a “letter of acceptance” to the Promoter evidencing that they have been accepted for a study abroad program at a University or College in Europe which has been organised by your current University or College (“Letter of Acceptance”).
8.2 Where any entrant submits an entry to this Competition and does not meet the criteria set out in section 8.1, their entry will not count and will not be considered for the Competition.
8.3 In order to be eligible to receive the Prizes, the First Place Winner, Second Place Winner and Third Place Winner are required to provide to the Promoter:
8.3.1 a Proof of Entitlement; and
8.3.2 a Letter of Acceptance.
8.4 The First Place Winner, Second Place Winner and Third Place Winner shall have fourteen (14) days from the date that the Promoter notifies them in accordance with section 6 of these terms and conditions to submit to the Promoter the Proof of Entitlement and the Letter of Acceptance. Where the Winners do not produce a Proof of Entitlement and the Letter of Acceptance within this period, the Promoter reserves the right to withdraw its decision and select an alternative First Place Winner and/or Second Place Winner and/or Third Place Winner as applicable.
8.5 Employees of the Promoter and their immediate families are ineligible to enter this Competition.
9. NOTIFICATION OF THE RESULTS AND RECEIPT OF THE PRIZE
9.1 The Promoter will notify the First Place Winner, Second Place Winner and Third Place Winner by email on or before the date which is thirty (30) days following the date this Competition closes as set out in section 5 of these terms and conditions.
9.2 The First Place Winner, Second Place Winner and Third Place Winner will receive their Prize within two (2) weeks of the date on which they provide the documentation referred to within section 8.3 of these terms and conditions.
10. PUBLICITY AND PERSONAL INFORMATION
10.1 The Promoter will use your personal information only in accordance with these terms and conditions and our privacy policy.
10.2 The surname and county of the Winner will be published at https://www.thetrainline.com/trains/study-abroad for one month after the closing date.
10.3 If you do not want your surname and county included on the list of winners referred to above, you must notify the Promoter a reasonable period of time before the closing date of the Competition.
10.4 You acknowledge that you may be asked to participate in publicity if you are selected as a winner.
11. LIABILITY
11.1 While nothing in these terms and conditions will limit the Promoter’s liability for death or personal injury caused by its negligence or for fraud, the promoter will not be legally responsible to entrants or winners for any losses that were not foreseeable to the Promoter or to the entrant at the time of entry to the Competition or which are caused by a third party.
12. INTELLECTUAL PROPERTY RIGHTS
12.1 All Competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
12.2 By submitting your competition entry and any accompanying material, you agree to:
12.2.1 assign to the Promoter all your intellectual property rights with full title guarantee; and
12.2.2 waive all moral rights,
in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
13. GENERAL
If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
The Promoter reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so.
These terms and conditions shall be governed by and construed in accordance with the laws of England and any disputes shall be subject to the non-exclusive jurisdiction of the English courts.
