OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA, WHO ARE 18 YEARS OF AGE OR OLDER (AND AGE OF MAJORITY IN HIS/HER/THEIR STATE/JURISDICTION OF RESIDENCE I.E., 19 YEARS OF AGE IN ALABAMA AND NEBRASKA, 21 YEARS OF AGE IN MISSISSIPPI, 18 YEARS OF AGE IN OTHER STATES) AS OF DATE OF ENTRY.
- SWEEPSTAKES PERIOD: The Trainline Romance by Rail Sweepstakes (the “Sweepstakes”) begins February 11, 2025 at 12:00AM Pacific Standard Time (“PST”) and ends March 11, 2025 at 11:59PM PST (the “Sweepstakes Period”).
- ELIGIBILITY: Open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older (and the age of majority in his/her/their state/jurisdiction of residence i.e., nineteen (19) years of age in Alabama and Nebraska, twenty-one (21) years of age in Mississippi, and eighteen (18) years of age in all other states), as of date of Entry. Employees of Trainline PLC (“Sponsor”), 360PR, (“Administrator”), their respective affiliated companies, parents, subsidiaries, and advertising agencies, promotional agencies and agencies/parties engaged in the development, production and distribution of promotion materials (collectively the “Sweepstakes Entities”), and each of their respective employees, directors, officers, assigns and agents and their immediate family members (defined as parents, grandparents, spouses, siblings, children and grandchildren) and those living in the same household (whether related or not) of each are not eligible to participate or win. The information you provide will only be used (1) in the event you are selected as a Sweepstakes winner; and/or (2) to send you marketing emails from Sponsor in accordance with clause 9.
- HOW TO ENTER: During the Sweepstakes Period, visit Trainline.com (“Site”), and complete the online registration form consisting of first name, last name, zip code, email address and the person with whom you would travel with, in order to be entered into the Sweepstakes (“Entry”). Limit one (1) Entry per person for the entire Sweepstakes Period. The person uploading the Entry will be deemed the entrant (“Entrant”) and to whom the prize will be awarded if determined a winner. All Entries must be received by 11:59PM PST on March 11, 2025. Duplicate or multiple Entries from the same person/email address are not permitted and will be automatically eliminated. Please be sure the person you have included in your Entry as your travel partner is aware and they have agreed that you may include them.
Any attempt by any Entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, logins, or any other methods will void that Entrant's Entries and that Entrant may be disqualified. The Sweepstakes Entities are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected Entries, which will be disqualified. Any use of robotic, repetitive, automatic, programmed or similar Entry methods or agents (including, but not limited to, sweepstakes entry services to create fraudulent email addresses and/or identities) will void all Entries by that Entrant. In the event of a dispute as to any Entry, the authorized account holder of the email address used to enter will be deemed the Entrant. “Authorized email account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. The potential winner may be required to show proof of being the authorized account holder associated with the Entry.
- RANDOM DRAWING/WINNER NOTIFICATION/VERIFICATION: One (1) potential winner, and one (1) alternate potential winner will be selected in a random drawing on or about March 12, 2025 from among all eligible Entries received during the Sweepstakes Period. A random drawing will be conducted by Administrator, an independent judging organization whose decisions are final on all matters relating to the Sweepstakes. The odds of winning a prize will depend on the total number of eligible Entries received for the Sweepstakes Period. In the event that an insufficient number of eligible Entries are received to award the prize, Sponsor is not obligated to award the prize. The potential winner will be informed on the email they will have provided and will have 48 hours to reply as described below. If the winner does not confirm acceptance of the prize within 48 hours of being informed they have won the prize, responds that they do not want to receive the prize, or has not met the condition of entry, then the prize will be forfeited and awarded to the alternate potential winner that will then become the winner once they complete all requirements stated above and below.
The potential winner will then be required to submit and return as directed, a Declaration of eligibility/release of liability/prize acceptance agreement (collectively, the “Declaration”) and return the Declaration within the time period specified at notification before being eligible to receive their prize. If the potential winner fails or refuses to sign and return such Declaration within the time period required by Sponsor or if the prize or prize notification is returned as rejected, faulty, unclaimed, or returned as undeliverable to such potential winner, such potential winner may be disqualified and the alternate potential winner will be contacted as described above. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the one prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised prize available may be selected in a random drawing from among all persons making purportedly valid claims for such prize. Inclusion in such drawing shall be each Entrant’s sole and exclusive remedy under such circumstances. The Sweepstakes Entities are not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify the potential winner. Potential winner is subject to verification by Sponsor and/or Administrator, whose decisions are final and binding in all matters related to the Sweepstakes. An Entrant is not a winner of the prize unless and until Entrant's eligibility has been verified and Entrant has been notified that verification is complete and that they have been declared the winner (“Prize Winner” or “Winner”) by Administrator. Sponsor and Administrator reserve the right to require potential winner to provide information necessary for Administrator to conduct a background check to confirm that such party is an eligible Entrant as defined herein, and Sponsor reserves the right in its sole discretion to disqualify any non-eligible Entrant.
- PRIZE AND APPROXIMATE RETAIL VALUE (“ARV”): One (1) prize consisting of: One (1) getaway for Prize Winner (“Prize Getaway” or “Prize”) consisting of a European vacation to London and Paris. The exact prize includes: a rail journey from London to Paris, a private breakfast dining experience in London, one night stay in a London hotel on July 24, 2025, a private dinner experience in Paris, one night stay in a Paris hotel on July 25, 2025 and a $5,000 travel stipend for any other travel expenses like air transportation, additional accommodations, food and beverage (excluding the food/beverages noted above), to be transferred in cash to the Winner’s bank account within 6 weeks, once provided. The Winner may travel with any person of their choice (but if a minor, it must be their child/charge). The Winner acknowledges that the London breakfast, Paris dinner and rail tickets will be on July 25, 2025 and the Winner must be available to travel on that date or they forfeit the prize. ARV OF PRIZE: $7,500.
All federal, state and/or local income and other taxes on the actual value of the prize are Winner’s sole responsibility. Winner is solely responsible for any and all expenses not expressly stated in the Prize Getaway description herein, including but not limited to, ground transportation in the United States to travel to London, Paris and in Europe, air transportation, hotel accommodations in-room hotel charges (e.g., mini-bar, room service, telephone, movies, etc.), meals, beverages, gratuities, gasoline, parking, tolls, souvenirs, insurance, visas and electronic travel authorizations, travel upgrades, baggage fees, and personal incidentals. Prize Winner will be required to provide a valid credit card at the time of hotel check-in and will be solely responsible for any and all charges to Winner’s hotel room during his/her Prize Getaway. All Prize details not specified in the Official Rules will be determined in Sponsor’s sole and absolute discretion. Prize Winner will be required to travel from London to Paris via rail journey on July 25, 2025. They must depart and return on Sponsor designated period. In the event the Prize Winner cannot travel on period designated by Sponsor, Winner will be disqualified, and the Prize will not be awarded. In the event the Winner does not travel on this getaway (unless otherwise agreed in writing between the Prize Winner and the Sponsor) they will repay any travel stipend already received. All Prize elements must be redeemed at the same time. Winner may extend their stay in Europe at their own expense. Prize Winner’s guest (or Winner on behalf of minor guest) must execute a release of liability prior to use of prize. Travel is subject to terms and conditions set forth in these Official Rules and those set forth by selected travel/rail providers (and specifically trainline.com), availability may vary, and material restrictions may apply. Winner will be solely responsible for obtaining a valid U.S. Government issued identification (including a valid US Passport) prior to travel and any associated costs for these requirements. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations to passengers, such as changes in services or accommodations necessitated by same. Sponsor shall not be liable for any loss or damage to baggage or other items. If the Winner is unable to or cannot otherwise fully enjoy the prize due to any reason, Sponsor shall have the option at its sole discretion of being relieved of liability for fulfillment of that Prize award, and no other compensation in lieu of the Prize will be awarded. All travel is subject to any and all restrictions instituted by the CDC and/or Department of Homeland Security, as required and if borders are closed due to COVID/any pandemic, Sponsor is not responsible and Sponsor may substitute prize of equal or greater value, in their sole discretion. All travelers must agree to abide by the latest travel guidelines/requirements at time of travel. Sponsor reserves the right, in its sole discretion, to substitute a prize (or portion of prize) with one of comparable or greater value should the prize become unavailable for any reason. Sponsor shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with the Prize provided pursuant to the Sweepstakes and/or any person’s participation in the Sweepstakes.
- GENERAL RULES/PRIZE AWARD: Rail tickets and Prize details/other portions will be sent to Winner via email to the email address provided within 6-8 weeks of the conclusion of the Sweepstakes Period. Return of Prize as undeliverable may result in disqualification and forfeiture of the Prize. Prize will not be re-issued if lost or deleted by Winner. Prize Winner and all Entrants, as a condition of Entry into the Sweepstakes and/or acceptance of Prize, agree to release and hold harmless the Sweepstakes Entities from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an Entry or otherwise participating in any aspect of the Sweepstakes, the receipt, ownership or use of Prize awarded, or any typographical or other error in these Official Rules or the announcement or offering of the Prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused by participation in the Sweepstakes or use or redemption of Prize. Acceptance of Prize constitutes permission to use Winner’s name, likeness, Entry, and any photographs, as applicable, for promotional purposes (including any possible public relations opportunities) without further compensation except where prohibited by law. By entering, Entrant accepts and agrees to be bound by these Official Rules. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes; violates these Official Rules; gains unauthorized access to accounts; acts in an unsportsmanlike or disruptive manner; or acts with intent to annoy, abuse, threaten or harass any other person. The Sweepstakes Entities are not responsible for technical, hardware or software malfunctions, for errors that may occur in promotion/ad materials, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, by any of the equipment or programming associated with or utilized in the Sweepstakes which may limit the ability to participate, or by any human error which may occur in the processing of the Entries in the Sweepstakes. Sponsor reserves the right to cancel or terminate the Sweepstakes if it cannot be completed as planned for any reason, including but not limited to bad weather, tampering, unauthorized intervention, technical failures or corruption of any sort. In the event of cancellation, the Prize will be awarded via a random drawing from among all eligible Entries received for Sweepstakes Period prior to cancellation. Void where prohibited by law and subject to all federal, state and local laws. As a condition of entering the Sweepstakes, Entrant agrees that: 1) under no circumstance will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with the Sweepstakes, or Prize awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event will Entrant be entitled to receive attorneys’ fees or other legal costs. In no event will more than the stated Prize be awarded.
- ARBITRATION: Except where prohibited by law, as a condition of participating in this Sweepstakes, Entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the Entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than Entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased.
- CHOICE OF LAW: THIS SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF CONNECTICUT, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN CONNECTICUT. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN CONNECTICUT. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. ENTRANTS AGREE ANY DISPUTE WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO CLASS ACTION.
